This Agreement ("Agreement") is entered into by and between Lokal CRM ("Company") and the user ("User") of the Company's software ("Software").
The Company agrees to provide the User with access to its software, Lokal CRM, offering two subscription plans:
Website-Only Plan: Includes a one-page website, website hosting, design, access, and a custom website chat widget to convert more customers.
Pro Plan: Includes all features of the Website-Only Plan plus access to the full CRM suite, enabling advanced lead tracking, sales tools, and communication features.
Once all necessary information is provided, the one-page website can be live within 3-5 business days
The $47/month fee or the Website-Only Plan covers:
* Website hosting and design.
* Google review widget for sending Google review requests.
* A website redesign every 36 months (if requested).
* Access to your website to make changes as needed.Up to 30 minutes of website maintenance per quarter, for minor text edits or updates. (This 30-minute block cannot be compounded each quarter. Major edits are billed at $97 USD/hour.)
* The CRM and all its features are available only in the Pro Plan for 97/month. Users can upgrade to the Pro Plan at any time.
The User agrees to pay:
* $47 USD per month for the Website-Only Plan
* $97 USD per month for the Pro Plan.
This is a perpetual monthly fee, paid via direct debit, and continues for the duration that the User wishes to keep the website live.
The User agrees to:
Comply with all applicable laws when using the Software.
Maintain the confidentiality of login credentials and accept responsibility for all activities under their account.
Make timely updates to billing information to avoid account deactivation.
What happens if I stop paying? If billing fails, your account will be paused. Your website will remain accessible on the internet for up to 45 days, during which you must fix your billing issue. After 45 days of unsuccessful payments, your website will be unpublished. You can reactivate it by resubscribing and contacting [email protected]
The Company will use reasonable efforts to ensure 24/7 software availability, except during scheduled maintenance or unforeseen outages. The Company is not liable for service interruptions.
Refund Policy: Payments are non-refundable and debited monthly. Contact: [email protected] for assistance.
Users may cancel their subscription at any time by logging into their account, navigating to account settings, and selecting "Cancel My Account." Upon cancellation:
* Your website will be unpublished and no longer searchable on the internet.
* The website cannot be transferred to another provider, including Wix, WordPress, or HighLevel.
The Company's Privacy Policy, available at www.lokalcrm.com/privacy explains how personal information is collected, used, and disclosed. By using the Software, the User agrees to these terms.
The Company is not liable for damages, income loss, or disruptions resulting from website issues. The Company's total liability is limited to the amount paid by the User in the preceding 12 months.
* Extra Costs: Email notifications for web inquiries and Google review requests are billed separately. Users start with $5 credit (~5,000 emails) and are rebilled $10 after credit expiration.
* Additional Features: Lokal specializes in one-page websites. Additional pages or advanced features can be discussed for scalability.User Logins: The Website-Only Plan includes one user login; the Pro Plan includes up to three.
* Website Ownership: Users cannot transfer their Lokal website to another platform.
Disputes must be resolved through good-faith negotiations.
This Agreement is governed by Australian law, without regard to conflict of law principles.
* 11a: Complimentary Website Construction
The Company provides complimentary website setup as part of the subscription.
* 11b: Content Backup
The User is responsible for backing up their website content. Upon termination, the Company may provide text document backups as a courtesy, if requested at least 15 days prior to deactivation.
* 11c: Proprietary Technology
Lokal CRM retains exclusive ownership of its proprietary technology and automation. Users may not replicate or utilize this technology after terminating their subscription.
* 11d: Usage Risks
Users assume all risks related to content and website operation. The Company is not responsible for backups, migrations, or related issues.
By checking the box on the registration form, the User agrees to these terms. This action serves as a legally binding electronic signature.
This Agreement supersedes all prior agreements related to the Software.
